There's Been No Videos of Substance, So Let's Talk Fair Use

February is almost over and it's been a dead month for Chris. Only three videos. Granted, it's a leap year and he could post something tomorrow, but we will see (he might read this and do so). Outside of the shitty app I talked about in the last post, the other two videos were about, surprise surprise, toys. Lego Dimensions Wave 3 and Minecraft action figures. Both videos were the same, he shows the packages, he unboxes them, and says they're really cool. There's some stupid stuff, like saying the Cyberman from Doctor Who "obviously" rides the Dalek like a vehicle (even though that never happened, could have rephrased that differently) but most of all they are boring. No wonder his subs stagnate or go down in big numbers when a new video comes out.

Soooo, let's talk about Fair Use. If you haven't been paying attention, the YouTube community has launched into a new campaign called "Where's the Fair Use" or #WTFU. Started by Doug "The Nostalgia Critic" Walker, various YouTube users are making videos and posts wanting YouTube to change their copyright policies. Altering their draconian ID bots, fixing the monetization system, and most of all actually helping users that felt they were wronged. Doug himself recounted how his channel could not receive revenue for 23 days thanks to a copyright strike, and the people at YouTube would do nothing about it. Only when he made a video and brought it to people's attention that they restored their monetization. But this only convinced him to start the campaign. Several people came forward in support. I Hate Everything, YourMovieSucks, Boogie2988, Jim Sterling, AlphaOmegaSin, GradeAUnderA, Markiplier, Ross "RubberNinja" O'Donovan, SFDebris, TeamFourStar, and so many more. The movement has gained enough traction that YouTube's CEO noticed it (though it's likely she won't do anything outside of "Yeah I hear you whatever")

What does any of this have to do with Chris Bores?
I'm curious how much Chris suffers from YouTube's terrible policies and ID bots. He never brings it up, and with all the copyrighted material he randomly uses, I have to imagine there's been several issues. Then again, this is the man that willingly kept copyrighted Power Rangers footage on a DVD he sells for profit. See this is where Fair Use can get a bit muddy. Many of the above people use the footage for commentary or criticism, but even they know not to put their material on DVD unless given permission or it's public domain. Chris was not using the PR footage for commentary or criticism, but to pretend to fight a robot like an episode of the show. He didn't add anything to it, he just used it because he was too lazy to make his own robot costume. Not to mention the Back to the Future footage waaaaaay back in the first season. He claims he got permission, but I don't believe him.

You'd think Chris would take this opportunity to address his own problems with YouTube, because I have to imagine he has them. If he leaves his bubble for one minute, and actually addresses this very real issue, I'll gain a tiny sliver of respect for him. Chances are he won't do it. He ignores pretty much everything unless it involves making James Rolfe look bad.

  1. Honestly, I would think Chris bringing this up would be hypocritical. Hasn't he false flagged videos that were critical of him claiming copyright in the past? Him complaining about Youtube's system would be like the pot calling the kettle black.

    I am curious to know what issues he may have had with his use of clips.

  2. I didn't know he claimed to have permission on the BTTF footage. If so, the DVD credits should have an explicit announcement to that effect.

    1. According to this post, the Goonies movie footage was removed from the DVD version of the Goonies II review, but the only movie footage removed from the BTTF review was the "Pepsi Free" bit. BatDan didn't post anything about the other DVDs because he has no access to them.

  4. One YouTube user who's dealt with a crazy amount of copyright crap is TheMysteriousMrEnter. He's had video removed several times for "copyright", he can rarely do videos of FOX shows since they ALWAYS take down videos that show any footage from their shows (including positive reviews), and his channel taken down for quite a while (not just for a day or a few hours, but for over two weeks) after several strikes from Viacom (a terrible, terrible company who seemed to be purposely trying to get rid of him). Today, several of his older videos (mainly FOX videos) are not available on his channel due to all of the flaggings and he always has to be prepared for getting his channel taken down again.

    I'm a huge fan of Mrenter and it really irritates me to see him deal with all of this crap due to a broken copyright system. YouTube, seriously, get it together!

    1. I been a fan of Mr Enter too despite some issues i have with how he makes videos, not just Windows Movie Maker crap, but tip-toeeing over copyright at times, tough now i dont think it matters anymore thanks to Content ID now being legit out of control that it makes anyone puke.

      Make no mistake, the Content ID as we know it know came in place due to the fear caused by the Internet Killing Bills and the like, blip keeping only the big guy reviewers but erasing everyone else under "Updated Copyright policies", dailymotion being also shit on fair use but more subtle than youtube (people still think dailymotion is a good alternative when its never really been), Vimeo outright forbidding video game footage and pretty much becoming a shitty social network app ala instagram for travels and pointless videos rather than a video sharing website, then all the dick moves that nintendo did regarding youtube, his recent releases, etc.

      It a fucking mess.

    9. They even made a "reviewing a reviewer" on Linkara, specifically his Street Fighter #1 (which I love that review). It's uninformative and biased, as you'd expect. The guy (it wasn't Asalieri) at one point even starts eating, which, in my opinion, in a review, is HIGHLY unprofessional. Just goes to show their credentials.

  6. Unfortunately everyone behind Where's the Fair Use will most likely go nowhere with this campaign as YouTube doesn't need to change anything if they so chose. And really why should they? What are all reviewers and the like on YouTube going to do leave YouTube, with Blip gone there really is no alternative. The only way things will change is if YouTube gets tried of everyone screaming about Fair Use(which as people smarter then me have pointed out is a defense not a right) or if the Fair Use law gets updated for the internet age(as other people have also pointed out). Speaking of Fair Use I can't remember where I heard this but apparently if you make a negative review of something(that's copyrighted) then the original owners are allow to take down your review, if that's true so many people would be screwed over.

  10. i have a smallish channel and even i've been snaked by copyright claims because of some music that happens to play in the background of my vids that you can barely hear.

    so yeah. it's not just the big guns getting hit. any one can get it, which makes it harder for smaller channels like mind to see any kind of success.

  11. Off-topic, but I was looking up a bunch of YouTubers on SocialBlade just now and I noticed that a whole bunch of users lost a bunch of subscribers on February 17. Not just Irate Gamer, but Markiplier, Cinemassacre, Game Grumps, JonTron, and even PewDiePie. They all for some reason lost a large amount of subscribers on February 17. Anyone know what's up with that?

    1. I think there have been glitches on YouTube lately. A video by LeafyisHere (who has over 1M subs and who uploads daily) was locked at about 100 views after hours of being up despite the fact that YouTube still displayed thousands of likes.

  12. I remember something like this happening back in 2010. I know Chuggaaconroy and NintendoCapriSun got their channels locked away for a few weeks. I think Chugga even said one of the strikes was some dude claming copyright of Chugga's voice.

  17. According to SocialBlade, Chris lost three subscribers today. That may not sound like a lot, but it kind of is when you barely get any subscriber gains.

    Chris, it really isn't a good idea to be posting numerous toy videos RIGHT after promising your fans that you would have a new IG episode out "hopefully in a week." It's actually a pretty big mistake.

      I never liked the idea of rebooting and replacing the starring cast with women. Plenty of feminist have already called me sexist, or a man-child who doesn't want icky girls in my playhouse. Personally, I think feminist should be offended by it. There's nothing empowering about accepting blatant pandering.

      When I first heard the rumors of Ghostbusters 3, the concept was that the original cast would be passing the torch to a younger generation. Among the rumored cast was Seth Rogen and Kaitlin Olson. Kaitlin was my favorite choice, Seth being the least.

      Despite my problems with the entire premise sounding like a bad gender-swap fanfic, I watched the trailer with an open mind, and hated it anyway.

      The "comedy" makes it seem like they're trying to give Ghostbusters the "21 Jump Street" treatment, when they should be giving it the "Ghostbusters" treatment. The original had a nice blend of drama and comedy, did the new production team think it was slapstick? The effects look nice, but everything else just seems generic and forgettable.

      I have less of a desire to see it after the trailer than I did before. Maybe I'll check it out when it comes to Netflix, but probably not.

    7. I personally laughed my ass off at it. I know a lot of people disagree with me; but I've seen Kristen Wiig do well on Saturday Night Live and in other movies; and Paul Feig definitely understands the dynamics of comedy (not to mention Melissa McCarthy bringing her usual blend of self-deprecating humor to the table). Hell, I didn't even hate Ghostbusters II! I can understand how people are upset; but a lot of them seem to be taking things way too seriously (something the Ghostbusters verse notably isn't). As for the Jump Street thing: I'm actually not a fan of the rebooted 21 Jump Street (I was vehemently against the idea of making it a comedy, and wished they stuck to how serious the show was and made the movie more similar to Collateral or American Gangster). I plan on going; because even if it sucks, I should be able to get something out if it as content for my YouTube channel.

    9. For me, I'm more surprised at making trailer reaction videos longer than the actual trailer. If it wasn't called Ghostbusters, perhaps it wouldn't be held to so much varied reactions.

      My first problem was the fact that they decided to call it "Ghostbusters" instead of adding a subtitle like the animated Ghostbusters shows did.

      It certainly won't ruin anybody's childhood, that's for sure.

      I wasn't really on/off the fence about it, so I'll just wait for the Rotten Tomatoes score for it to help influence in going to seeing it/not.

  22. So, what do you think about the recent Nintendo Direct announcements? Here are my thoughts:

    • No official announcement of playable Octolings in Splatoon. I guess they're saving that for E3. They did say that updates are still coming for that game, however.
    The Japanese Super Mario Maker info video about the upcoming Wednesday update actually has a few tidbits of information that the Direct itself doesn't have. Specifically, you can carry up to eight keys (since you can put up to eight sets of doors in a course, four for each sub area, it makes sense), one of the Super Expert costumes is Diskun (#143 in the costume roster), and there's a new viewer for courses that you've uploaded that lets you check out death spots and comments without having to play through the courses yourself.
    • Localization for the 3DS Rhythm Heaven game has finally been confirmed! I guess when it comes to Rhythm Heaven, these things take their sweet time.
    • Kirby, Meta Knight, and King Dedede are getting new figurines for the Kirby amiibo line. Waddle Dee will also be getting an amiibo.

    In other news, the Shovel Knight amiibo has been confirmed for Japan, but not Silver Mario.

Well, think I'll work more on Blue on Virtual Console (I picked Squirtle, which made Misty tougher than I thought with no grass or electric types handy) and finally play in the Kanto Classic in OR/AS; as well as catch up on Jessica Jones on Netflix (Daredevil season 2 starts soon, really excited with how they'll handle the Punisher). There were a lot of good nominees this year; and I'm glad Mad Max swept the technical awards (despite not being the biggest fan of Fury Road; I can't deny how well-made it was), and I concede it was a tough call on Best Picture myself. I am glad that Leo finally made Best Actor after being nominated numerous times, and that living legend Ennio Morricone won Best Original Score.

    2. It's decent; and it has some nice animation compared to how glitchy the games were (I like how one episode apparently canonized the Knuckles jump glitch). It's a bit more action-oriented than AoSTH; but goofier than SatAM (I still think Underground is the weakest Sonic show I've seen). It's getting a second season soon; and I'm seeing a lot of parallels with the new TMNT as well (something that wasn't lost on VG Cats or Black Nerd Comedy). As for this Fire and Ice game: I will just have to see where that goes (I tried to give Rise of Lyric and Shattered Crystal the benefit of the doubt; but just playing the demos, I could say many fans' skepticism was justified). Even Sticks is pretty amusing to me; especially as a man who's not a big fan of Nika Futterman's voice acting.

    4. The main reason I hate it is because, frankly, it just isn't that interesting. No really, think about it. Most of the show's plots have been done before, 80 percent of the cast are just boring sterotypes that barely do anything (looking at you Amy) and it's trying to be a million different things at a time. In some episodes, it's trying to be an Adventure Time-like action comedy. In others, it's a sitcom. That's not diversity, that's being inconsistent.

OT: The new Civil War trailer seems to have finally leaked how Spider-Man will appear in the Marvel Cinematic Universe; and I think "Underoos" (as Tony calls him) looks to be an improvement over The Amazing Spider-Man 2. I'm also eager to see how the film will be used a springboard for the single-hero reboot film next year; as the design looks quite similar to Steve Ditko's original design for the character when he first appeared in Amazing Fantasy #15. Needless to say, I'm quite excited to see what Tom Holland brings to the table.
